Artículo 159. Prohibición de Antecedentes. Las sentencias proferidas en procesos por responsabilidad penal para adolescentes no tendrán el carácter de antecedente judicial. Estos registros son reservados y podrán ser utilizados por las autoridades judiciales competentes para definir las medidas aplicables cuando se trate de establecer la naturaleza y gravedad de las conductas y la proporcionalidad e idoneidad de la medida. Las entidades competentes deberán hacer compatibles los sistemas de información para llevar el registro de los adolescentes que han cometido delitos, con el objeto de definir los lineamientos de la política criminal para adolescentes y jóvenes. |

Artículo 20.- Derecho a la privacidad
Los menores de edad tendrán derecho a que se les respeten su vida privada y la de su familia. Consecuentemente, se prohibe divulgar la identidad de un menor de edad sometido a proceso. Artículo 21.- Principio de confidencialidad Serán confidenciales los datos sobre los hechos cometidos por menores sometidos a esta ley. En todo momento deberán respetarse la identidad y la imagen del menor de edad. Los Jueces Penales Juveniles deberán procurar que la información que brinden, sobre estadísticas judiciales, no contravenga el principio de confidencialidad ni el derecho a la privacidad, consagrados en esta ley. Artículo 99.- Oralidad y privacidad La audiencia deberá ser oral y privada, so pena de nulidad. Se realizará con la presencia del menor de edad, su defensor, el ofendido y el Fiscal. Además, podrán estar presentes los padres o representantes del menor, si es posible; los testigos, peritos, intérpretes y otras personas que el Juez considere conveniente. |

Canada 1. 110. (4) A youth justice court judge shall, on the ex parte application of a peace officer, make an order permitting any person to publish information that identifies a young person as having committed or allegedly committed an indictable offence, if the judge is satisfied that (a) there is reason to believe that the young person is a danger to others; and (b) publication of the information is necessary to assist in apprehending the young person.
